On February 17, 2012, representatives of pharmaceutical companies gathered for a business breakfast organized by Arzinger Law Office together with Audit Company Aksonova & Associates in order to discuss current issues of the tax legislation. The event took place within the framework of Arzinger Academy Legal Days.

Pavlo Khodakovsky, Partner at Arzinger, and Svitlana Yazykova, Senior Associate at Arzinger, spoke about the main possibilities to formalize contractual relations with individuals that are used by pharmaceutical companies. In particular, Svitlana presented a comparative characteristic of taxation for an individual and a company by different types of contractual relations between them. She explained in detail peculiarities of taxation for different types of contractual relations, in particular: for an employment agreement, a civil agreement, a contract with a private entrepreneur (general system), a contract with a private entrepreneur (simplified system) and an outsourcing contract.

Afterwards spoke Elena Makeeva, Managing Partner at the Audit Company Aksonova & Associates. In her report “Activity of a Non-Resident’s Representative Office” in Ukraine: new rules and old problems” she focused on the issue of construction of the term “permanent representative office” in the new  interpretation of the Tax Code of Ukraine, including an extended list of activity types of non-residents that result in a permanent representation in Ukraine. Besides, she told about taxation procedure applied to such representative offices and presented to her listeners the nine postulates of “non-commercial” representative offices.

After speakers’ reports participants of the business breakfast had a chance to ask experts their questions and to share their experience with colleagues.
