DLA PIPER COMPETITION TEAM WRITES ABOUT CARTELS IN UKRAINE FOR THE GLOBAL LEGAL INSIGHTS BOOK

Kyiv – Competition team legal director Galyna Zagorodniuk co-authoring with an associate Lilia Boulakh recently contributed to the first edition of "Cartels: Enforcement, Appeals and Damages Actions" published by Global Legal Insights.
Ukraine's chapter of the book is designated to provide a practical insight into cartel enforcement policy and procedure. It includes leniency program, administrative settlement, sanctions and appeals. The chapter provides own judgment of legal and policy issues and offers insights into Ukrainian regime related to anti-cartel provisions. It also contains analysis of the approach taken by the Ukrainian competition authority comparing to other 29 competition authorities worldwide.
Galyna Zagorodniuk comments: "The practical importance of the topic for business is based on the fast-changing approach of AMCU towards violations regarding competition. First of all it refers to anticompetitive concerted actions, including cartels. In 2012 AMCU has completed an investigation on a number of existing in Ukraine cartels, levying record fines on them. Some investigations are still ongoing at the moment of the publication. We hope that this article not only gives the readers a general idea of what cartels are, but also will serve as a guide towards practical approach of AMCU to regulation of cartels. Additionally we included interesting statistics about the latest investigations and decisions of AMCU".
