Taxauthorities took the company to trial, seeking an additional UAH 3 million invalue-added tax in connection with the corporate reorganization. The KyivAppeals Administrative Court ruled in favor of the company upon appeal.
The courtfully upheld the company's position that the transfer of assets in thereorganization process cannot be considered as part of the aggregate grossassets, according to article 3.2.8 of the law on VAT. The law precludes accrualof tax liabilities for VAT in accordance with article 7.4.1 of the act.
The legalposition of the case was developed by senior associate of tax practiceOleksandr Maydanyk, who also represented the interests of the client in courtwith Arsen Miliutin, co-head of the tax and customs litigation practice in Ukraine.
