Markian Malskyy, Head of Alternative Dispute Resolution practice and Head of West Ukrainian Branch of Arzinger Law Office, participated in the 15th Annual IBA International Arbitration Days, which took place on 08-09 March 2012 in Stockholm, Sweden. It is a must-attend event for everyone interested in current developments and practice in the field of international arbitration, being a meeting place for arbitrators, litigators, judges, in-house counsel, government officials and all those involved in dispute resolution.

The conference was presented by the IBA Arbitration Committee and supported by the IBA European Regional Forum. This year conference was entitled "Neutrality: myth or reality?" and included following topics on agenda:

  • arbitrators – subject to suspicion,
  • is procedure really neutral,
  • how neutral is the system of investment arbitration,
  • the IBA Guidelines on Conflicts: setting the standard or in need of revision.

Purpose of the event was joining the leading practitioners in exploring the multifaceted topic of tribunals' powers, both substantive and procedural, in the conduct of arbitration proceedings.

Moreover, Markian Malskyy, being as well a listed Arbitrator with the Dubai International Arbitration Centre (DIAC), took part in the DIAC 4th Arbitration Dialogue. The purpose of this meeting was to create a platform for direct and open dialogue between DIAC users and the Executive Committee Members to exchange their views and comments and to raise any questions or feedback related to DIAC services.

As Head of Alternative Dispute Resolution practice at Arzinger and a recommended arbitrator of several arbitral institutions, Markian Malskyy has been involved in settlement of over 300 disputes. He is the author of two books on commercial dispute settlement, and has over 70 legal articles published. Mr. Malskyy is an advisor to the Governor of the Lviv oblast, Deputy Chairman of the European Business Association (EBA), Chairman of the EBA Western Ukrainian Branch Legal Committee.
