Oleg Kachmar Speaks at the 5th International Insurance Law Conference

The heads of insurance companies, lawyers,settlement and recourse experts, underwriters, officers of economic securityagencies, insurance brokers and other industry representatives attended the event. 

The key issues proposed for consideration bythe experts included the following: 

• legal relationships with state regulators;
• the new terms of paying out insurance claims, combating insurance fraud, justifying the amount of damage;
• pressing legal issues related to business, agricultural and other property risks hedging;
• legal support for underwriting processes, defining policy provisions, recourse, subrogation, etc.;
• in-house lawyers, legal department or outsourcing: their roles and application;
• pre-trial settlement of insurance disputes;
• review of insurance related litigation cases.

During the conference Vasil Kisil & Partners’Senior Associate Oleg Kachmar gave apresentation on Certain Aspects of Insurance Related Litigation Cases. MrKachmar’s report highlighted the right of the policy holder to file a courtaction against the insurance carrier provided that a beneficiary is stipulatedin the agreement, reviewed the procedure for challenging the existence of theinsured property and providing evidence confirming the occurrence of theensured event, particularly, the moment of its occurrence and thecause-and-effect relationship in agroinsurance. He also delved into thepractice of disputing the validity of insurance contracts.  

At the conclusion of the conference Olegpointed out that “such events are anexcellent platform for open dialogue among experts working in the insuranceindustry and for discussing the latest trends in legal regulation of thissector while fostering professional contacts.”
