Oleksandr Mamunya Explores How the Association Agreement with the EU Might Effect Businesses during IP Forum

On June 26, 2014, Kyiv hosted the Intellectual Property Forum (IPF) 2014,organized by Yuridicheskaya Practika Publishing with the support of the StateIntellectual Property Service of Ukraine with the support of Vasil Kisil &Partners law firm represented by partner and co-chair of its IntellectualProperty Practice Oleksandr Mamunya.
The event brought together over 150 lawyers specializing in theprotection of intellectual property (IP), law practitioners, patent attorneys,legal experts, judges, and government officials. Participants discussed thedevelopment of investment attractiveness of national IP and the future of theEuropean IP market. According to organizers, the forum will be held annually,and is to become international in the future.
OleksandrMamunya presented at thesession devoted to discussing IP-related risks and prospects for Ukrainianbusiness in connection with the signing of an Association Agreement with theEU, as well as the hot topic of legal consequences brought on by the occupationof the Crimea. Mr. Mamunya in his speech considered possible predictableconsequences of signing and implementing an Agreement with the EU in thecontext of individual norms and mechanisms for the protection of IP rights.Thus, according to Oleksandr, the entry into force of such innovations as thepublication of applications for registration of trademarks, individualizationof industrial designs (which will combat patent "trolls"), therequirement of a high level of efficiency and transparency of collectivemanagement of copyright and related rights, strengthening the rights of theemployer to computer programs (bound to improve business conditions in thefield of IT) will surely have a positive impact. At the same time Mr. Mamunyabelieves that some of the requirements and standards may complicate the work incertain areas that are sensitive to the protection of IP rights.
To sum up Oleksandr said: "Businessis much more willing to invest in the economy with a known set of rules. If,despite some difficulties, the overall system will be implemented as planned,it will pay dividends for many businesses in Ukraine, making the country moreopen and attractive to investors."
