Further to our Legal Alerts concerning legal regime for the personal data protection, we would like to remind you that the Law “On Amending Certain Legislative Acts of Ukraine regarding Enhancement of Responsibility for Violation of Legislation on Personal Data Protection” (the “Law”) stipulates serious administrative and criminal sanctions for violations in the area of personal data protection, which are scheduled to take effect as of 1 July 2012.

The date for the sanctions to take effect has been already postponed once, and it may happen that it will be postponed one more time: on 6 June 2012 the Draft Law No. 10570 providing for postponement of the effective date of the Law from 1 July 2012 to 1February 2013 was registered with Verkhovna Rada (Parliament) of Ukraine.

If this measure is adopted, the Ukrainian companies will have six more months to comply with the Ukrainian legislation on personal data protection and to bring their internal documents in order.
