On November 17, 2011, Vasil Kisil & Partners hosted a seminar on “Personal Data Protection in Ukraine” where Oksana Voynarovska, Counsellor with Vasil Kisil & Partners, and Vladyslav Podolyak, Attorney-at-Law and Leading Associate, delivered their speeches.

The items discussed during the seminar included the history of personal data protection, theoretical approaches and legal regulation in the sphere of personal data protection in Ukraine, and the very concept of personal data.

When asked whether data are personal data or not, Mrs. Voynarovska and Mr. Podolyak recommended the attendees to decide this issue on a case-by-case basis by answering the following three questions:

1. Does such data relate to a person?
2. Can anybody identify a person by using such data?
3. Does such data contain any information on (description of) a person?

Together with the seminar attendees, Oksana and Vladyslav discussed the requirements to processing general and “sensitive” personal data, gave examples showcasing the ways of keeping personal databases for specific industries, and thoroughly considered the principal rights of business entities.

26 lawyers and representatives of HR departments from leading Ukrainian companies showed great interest when discussing with Ms. Voynarovska and Mr. Podolyak the topic of bringing the company operations in compliance with the statutory requirements, matters of state registration of personal databases, competence of the State Service of Ukraine for Personal Data Protection, as well as liability for offences related to personal data protection.

At the seminar closing, representatives of Vasil Kisil & Partners gave practical advice to the seminar participants regarding the methods of personal data protection.
