Key Features of the Newly Adopted Law On Privatization

Kyiv, Ukraine, 28 March 2018 — Baker McKenzie acted as the legal counsel to the European Bank for Reconstruction and Development and the Ministry of Economic Development and Trade of Ukraine in connection with reform of the legal framework to achieve more efficient, transparent and straightforward rules for privatization in Ukraine.

Managing Partner Serhiy Piontkovsky led the Kyiv office team on the project, with key input from Senior Associate Andrii Moskalyk and Associate Oleksandr Kez.

The newly enacted Law of Ukraine On Privatization of State and Municipal Property introduces a new approach to determination of the starting price for the sale of privatization assets, improves regulation of privatization agreements and temporarily allows parties to choose English law as the governing law.

“We are grateful for this opportunity to share our experience accumulated over nearly 20 years of privatization projects in Ukraine. Our firm is happy to have been engaged in this almost two-year-long reform and to assist the EBRD and the MEDT with creating efficient and transparent privatization rules in Ukraine," Serhiy Piontkovsky comments.
